the plaintiff, an African-American woman, began working as the Deputy Director of the OSDBU, an office within the Department of Health and Human Services. Pl.'s Opp'n to Def.'s Renewed Mot. for Summ. J. ("Pl.'s Opp'n") at 3. Her first line supervisor was Debbie Ridgely, a white female, the Director of the OSDBU. Id.
In 2004, Ridgely hired Clarence Randall, a white male, to serve as her "Special Advisor," a position created, the plaintiff claims, to supersede the plaintiff's position. Id. at 3. The plaintiff alleges that over the following months, Ridgely transferred many of the plaintiff's responsibilities to Randall, such that Randall effectively assumed the role of Ridgely's deputy.

Where’s the accountable of the first President of color? Now we’re asked to re-elect a failed Presidency. Unemployment is out of control especially among people of color. Excuses made daily for the presidents lack of moral courage. We’re living a lie that Racism and colorism have vanished because of the election of a person of color who knows very little and/or has no experience of racial indifferences towards Blacks in America. The government is failing to insure the Life, liberty and the pursuit of happiness for Blacks. President of color and Attorney General of color are both ignoring gross discriminations based on Race covered by the Executive branch. Why other than the devil we know verses the devil we don’t know should anyone re-elect the failed presidency of the Obama’s?

Permalink Reply by Ricardo Jones on November 28, 2012 at 4:21pm In my opinion you are correct - this administration and the one before it did put individuals like Ridgely and Randall in high ranking positions to undermine opportunities for minority contractors and institutions of higher learning. What you misunderstand is that there are no "set-asides" or rights for minorities to obtain contracts in the federal contracting. The closest we came to having minority set-asides was prior to the Adarand, Crosen and Rothe decisions. Most recently it appears the DOD is backing around from even the 8(a) program because of a hostile Supreme Court towards minority business set-asides.
This is not an Obama issue - is my point. This is a government culture issue that was legitimized during the Clinton administration, got worst during the Bush administration - and hasn't been identified or dealt with during the Obama administration.
Again, my issue is that the Obama administration defended what they knew was improper and possible illegal conduct by the agency officials. They admitted that the conduct was improper in open court. I had an attorney who appears to have assisted the agency officials because what of what I think may be his interest with the Republican party.

This trial is an injustice against all Black people. White racist Bigots at HHS contracting deverting 30% of set a side ear marked contracts from Historic Black colleges and universities to others they friends and non-Black colleges. Contact the adminstration and Katheen Sebelius head of HHS an Obama appointee to answer How, Why and to account for all funds deverted from HBCU’s and to reinstate Holms-Martin with all pay and benefits immediately.
